There is a new system of laws and rules for the resolution of Family Law disputes happening in Australia. Beginning 1 September 2021, there is a new Federal Circuit and Family Court of Australia (FCFCOA).
The FCFCOA is embracing innovation, technology and change. Especially the greater use of more helpful and less expensive dispute resolution to settle family matters “both before and during court proceedings”.
Litigated proceedings should see seen as a last resort. The Court expects people to make genuine attempts to engage in dispute resolution, to avoid the time, cost and stress associated with litigation. Now all families that are caught up in the legal administration of their family conflict are encouraged, supported and directed to use the services of accredited Family Dispute Resolution Practitioners (FDRP), accredited Mediators and experienced family law Arbitrators..
